Non-Compete Policy

Summary

University at Buffalo Graduate Medical Education (UB GME) adheres to the policy of the Accreditation Council for Graduate Medical Education (ACGME), which prohibits the inclusion of any restrictive covenants or non-compete clauses for residents or fellows.

Policy Statement

No UB-sponsored, ACGME-accredited program will ask for a resident or fellow to agree to a non-compete or restrictive covenant clause as a contingency of residency/fellowship training.

Residents and fellows are advised they may not sign a non-compete or restrictive covenant clause as part of any UB GME or program documents, or as a contingency for employment as a resident/fellow in a UB-sponsored, ACGME-accredited program. Residents and fellows must immediately notify UB GME if they are asked to sign such a document.

Applicable Requirements

ACGME Institutional Requirement effective 7/1/2022 (IV.M.):

  • Non-competition: The Sponsoring Institution must maintain a policy which states that neither the Sponsoring Institution nor any of its ACGME-accredited programs will require a resident/fellow to sign a non-competition guarantee or restrictive covenant. (Core)
